This consultation provides a draft of the guidance that we will publish to support commissioners with the process of designating services which should be protected. This consultation closed on 22 November 2012.
Monitor will support commissioners to make sure that services continue to be available to those who need them, even in the rare event of the failure of a health care provider. In the event of failure, certain key services will be 'protected', ensuring that they cannot close without adequate replacement.
The guidance and The Designation Framework (in annex 1) set out an end-to-end process that will guide commissioners from initiating the process of designating services as Commissioner Requested Services under Monitor's provider licence, through to finalising their decision about which services to protect in the rare event of provider failure.
