This is the first major report to be published by Monitor in its new role as sector regulator for health. It addresses the extent to which all potential providers of NHS care have a fair opportunity to offer their services to patients.

Earlier this year, the Secretary of State for Health asked Monitor to carry out an independent review of 'matters that may be affecting the ability of providers of NHS services to participate fully in improving patient care'. The purpose of this document is to update stakeholders across the health sector on the progress of the review and to invite comments on specific issues that have arisen in our work.
