Consultation on Amendments to the Compliance Framework for 2010/11
This consultation explained how Monitor intends to develop and enhance the effectiveness of the Compliance Framework in 2010-11.
Our proposals in the consultation covered two main categories:
1. Governance and risk ratings, including proposals covering:
- the introduction, from 1 April 2010, of the Care Quality Commission’s enhanced registration requirements;
- a redesign of our structure for rating governance risk, to reflect more closely an escalation of risk towards a potential significant breach of the terms of Authorisation, incorporating an additional measure of emerging risks;
- the inclusion of mandatory services risk within our governance risk rating;
- an extension and redesign of service performance measures for mental health foundation trusts, to provide a better overall indication as to whether mental health trusts are well led;
- clarification of clinical quality governance expectations;
- inclusion, as in previous years, of relevant priorities from the Operating Framework, which was published on 16 December 2009; and
- the duty in the Health Act 2009 for NHS foundation trusts, as with all NHS organisations, to have regard to the NHS Constitution.
2. Finance and risk ratings, including proposals covering:
- a refinement of our approach with regard to the assessment of potential financial risks, and in particular a greater focus on additional indicators of likely future financial weakness. This is particularly relevant in the context of an anticipated future slowdown in funding of health services.
The proposals, if agreed, will be for inclusion in the 2010-11 Compliance Framework. We will publish a summary of the consultation responses. We aim to publish an amended Compliance Framework for 2010-11 by 1 April 2010.
