We received 66 responses (including the response from the Foundation Trust Network on behalf of a number of NHS foundation trusts) to the consultation on amendments to the Compliance Framework for 2010/11, which were considered when finalising the revised framework.

We received 66 responses (including the response from the Foundation Trust Network on behalf of a number of NHS foundation trusts) to the consultation on amendments to the Compliance Framework for 2010/11, which were considered when finalising the revised framework.

We have consolidated the comments received and comment on these in the summary of consultation responses, available below.

We have used the responses to help develop and enhance the Compliance Framework, to include, in particular, the introduction of Care Quality Commission registration from 1 April 2010, the key aims of the Operating Framework for the NHS 2010-11 and a range of indicators of future potential financial weakness.

The amendments outlined below will come into effect immediately, in the revised 2010-11 Compliance Framework:

  • changes to reflect the introduction, from 1 April 2010, of the Care Quality Commission’s enhanced registration requirements;
  • a redesign of the structure for rating governance risk so as to reflect more closely an escalation of risk towards a potential significant breach of the Authorisation;
  • an extension and redesign of service performance measures for mental health foundation trusts;
  • clarification of clinical quality governance expectations;
  • the inclusion of mandatory services risk within our governance risk rating;
  • a refinement of our approach with regard to the assessment of indicators of potential financial weakness; and
  • the duty in the Health Act 2009 for NHS foundation trusts, as with all NHS organisations, to have regard to the NHS Constitution.
