This document sets out the different elements of the Terms of Authorisation that an NHS foundation trust may apply to vary, the criteria by which Monitor will determine whether to authorise a variation; and the processes required to effect a variation.

Monitor’s Variation of Terms of Authorisation: Guidance for NHS Foundation Trusts sets out:
- the different elements of the Terms of Authorisation that an NHS foundation trust may apply to vary;
- the criteria by which Monitor will determine whether to authorise a variation; and
- the processes required to effect a variation.
The revised version of this guidance, published on 18 July 2007, has substantively the same content as that published in October 2004, but in a shorter, more user-friendly format. This revision has also provided an opportunity for the guidance to be updated to reflect changes made in legislation and other guidance since the original document was published in 2004.
