Please note: the provisions of the Health and Social Care (Community Health and Standards) Act 2003 (the 2003 Act), which relate both to Monitor and to NHS foundation trusts, were repealed on 1 March 2007 and re-enacted on that date in a consolidating act, the National Health Service Act 2006.

After 1 March 2007, it will not be incorrect to refer to old legislation, including the 2003 Act, as the law provides that reference to repealed acts must be taken as a reference to the corresponding provision of the consolidating act.

As appropriate, Monitor will be revising its existing documentation which includes references to repealed legislation.
